Planning for Incapacitated Persons
A Special Needs Trust allows you to nominate a trustee who will hold and administer an estate for the benefit of someone, who either due to a mental or physical incapacity is not able to manage their own affairs. By using the funds only for their “special needs”, the incapacitated beneficiary can still retain certain government benefits to which they are entitled.
